Fire On The Mountain

No issue in insurance coverage could be more topical at this time of the year than fire losses. The Napa and Sonoma County fires, as well as lesser wildfire losses in the Anaheim area, may well give rise to more coverage disputes than we have seen since the Oakland Hills (Tunnel) fires of the nineties. This webinar will offer a timely discussion of the status of both statutory and case law dealing with fire coverage and the changing area of the definition, terms and concepts including “actual cash value”, “fair market value”, and “total replacement costs”.  The webinar will go into detail on the three Replacement Cost Valuations and tests, including replacement cost coverage, extended replacement cost coverage, guaranteed replacement cost coverage and replace cost coverage plus.  Suggestions for best practices in claims handling on fire loss claims will be included with a goal that the attendees will have improved competency regarding California’s Insurance Code and Cases regarding the fire loss issues.

Ms. Carner is a Partner and member of Freeman Mathis & Gary’s Professional Liability and National Insurance Coverage Practice Sections. She has extensive litigation experience representing insurers in bad faith and insurance coverage lawsuits. Her insurance expertise includes coverage advice in the areas of general liability, professional liability, broker’s and dealer’s, property and casualty, D&O, workers’ compensation, and employers’ liability coverage. She has also handled significant litigation involving coverage issues relating to bodily injury, personal injury, advertising injury, and property damage.

Ms. Carner continues to successfully defend employers in various employment disputes including claims of discrimination, wrongful termination and sexual harassment/abuse.  She has substantial experience handling general business disputes and in defending professionals in cases alleging errors and omissions by lawyers, accountants, escrow agents, directors, officers, insurance agents, and insurance brokers.  Ms. Carner advises HOA boards and their directors in various matters and defends them in litigated disputes.  In addition, she has successfully briefed and argued numerous appeals in California state and federal appellate courts on behalf of her clients.

Mr. Moura is an associate in Freeman Mathis & Gary’s Los Angeles office. Mr. Moura is a member of the firm’s Commercial and Complex Litigation group, the Coverage and Bad Faith group, and the Data Security, Privacy & Technology practice team.

Mr. Moura’s complex litigation practice includes representing insurers in complex coverage and reinsurance disputes, including reinsurance arbitrations. He represents insurers in the defense of claims in financial, business, and casualty matters. He also represents insurers in “bad faith” actions and provides insurance coverage opinions involving complex coverage disputes.

Mr. Moura’s data security practice includes acting as data breach counsel to provide comprehensive assistance in the event of a data security incident, in addition to consulting clients on compliance with state and federal cyber regulations.

Mr. Moura has successfully briefed and argued appeals in the California Courts of Appeal and Ninth Circuit Court of Appeals, and litigated several cases through bench and jury trials.
