Written vs oral advocacy and pursuing discretionary review in the appellate courts

Appellate advocacy differs significantly from trial skills in several ways. Whereas the trial lawyer’s general focus is on the credibility of the evidence to prove certain facts, the appellate lawyer’s aim is to advance the legal issues so as to uphold or reverse the decisions of the trial judge. Even within that sphere, different strategies come into play in presenting the issues in a written brief as opposed to oral argument in the appellate court.
