FMG attorneys Lorne Hiller and Jay Graif prevailed on a motion for judgment on the pleadings asking the Court to determine that there was no duty to defend or indemnify under two policies of insurance for an alleged $3.5 million fraudulent scheme to defraud investors in a food business in New Mexico. The Court agreed that the Prior Acts Exclusion of one policy precluded coverage for acts taking place prior to the policy’s inception, even though those acts continued into the policy period. Further, the Court agreed that one of the individuals involved was not being sued solely because of his status as an insured’s spouse, but rather, for his own alleged fraudulent acts, thereby precluding coverage for him. The Court additionally held that the dismissal was with prejudice, meaning the plaintiffs would not be permitted to attempt to amend the complaint.
