FMG attorney Shawn Bingham prevailed at summary judgment in a South Carolina federal court for an insurance company in an insurance coverage dispute arising from the construction of a large mixed-use development in Myrtle Beach, South Carolina. The plaintiff, who was the general contractor for the development, sued FMG’s client, which insured a subcontractor, alleging that the insurer owed defense and indemnity in an underlying construction defect lawsuit to the general contractor as an additional insured under its policy. The court granted FMG’s motion for summary judgment, finding that the plaintiff had failed to prove that any property damage occurred during the term of the insurer’s policy or that the general contractor qualified as an additional insured.
