Zach Smith is partner in Freeman Mathis & Gary’s San Francisco office.  Mr. Smith is an experienced trial lawyer, who has tried more than 35 cases to verdict, leading to his nomination and acceptance into the American Board of Trial Advocates (“ABOTA”).  At the time of his induction, he was the youngest member of this prestigious, invitation only organization. His approach and successes also resulted in him being named the Distinguished Defense Attorney of the Year by the San Francisco Trial Lawyers Association (2018). He has also earned an individual AV Preeminent rating from Martindale-Hubbell.

Mr. Smith’s reputation as a premier courtroom attorney has resulted in clients requesting his services to defend high-exposure corporate disputes, including the defense of directors and officers in breach of fiduciary duty claims, as well as professional negligence claims brought against physicians, lawyers, real estate brokers, technology executives, and insurance brokers and agents.  His ability to evaluate claims and develop thoughtful strategies and themes have led to successful outcomes in state and federal courts throughout California.

His experience also includes the successful management of other types of commercial claims, products liability, including real property (homeowner association and landlord-tenant), defamation and trade libel, intellectual property and trade secret (trademark, false advertising, and inappropriate use of confidential information), and claims brought under various federal and state statutes for claimed improper business operations (False Claims Act, Fair Debt Collection Practices Act, Telephone Consumer Protection Act, and Unfair Business Practices Act).

Mr. Smith has also developed a specialty for the defense of multi-million dollar catastrophic injury and death cases, where his technical expertise in the handling of brain, spinal cord and paraplegia, loss of limb, and nerve and conduction losses, makes him a “go to” counsel for ensuring appropriate evaluation and the capability of presenting challenging matters to juries that lead to successful outcomes for his clients.
