Wayne Hammack is a Partner in Freeman Mathis & Gary's Los Angeles Downtown office. He has over two decades of wide-ranging trial experience in state and federal courts throughout California.
Mr. Hammack has substantial experience representing insurance companies in both coverage and extra-contractual claims involving multi-million dollar exposures as well as defending agents and brokers who have been sued for malpractice. He also has extensive experience in defending against a wide variety of professional negligence claims including agent/broker malpractice, legal malpractice, and medical malpractice. Mr. Hammack has also defended clients in complex negligence, premises liability, and toxic tort claims.
Mr. Hammack’s employment law practice includes defense of wrongful termination, wage and hour, FEHA claims, and EEOC claims. Additionally, he advises and counsels employers concerning their workplace policies, practices, and personnel decisions. He also regularly defends employers against employment claims for breach of contract, discrimination, retaliation, harassment, wrongful termination, unfair business practices, violation of wage and hour laws, as well as numerous other tort and statutory employment law causes of action.
Mr. Hammack’s experience in professional liability matters includes representation of lawyers and law firms in legal malpractice claims, land surveyors and architects in construction defect claims, and medical practitioners, dentists, hospitals and nursing homes in malpractice and elder abuse claims. His medical malpractice defense experience includes the defense of doctors and hospitals against claims of elder abuse, birth injuries and other catastrophic damages. He also represents physicians in matters involving disputes relating to formation and dissolution of Independent Physician Associations.
Mr. Hammack’s commercial litigation practice includes defense of a wide array of businesses, nonprofits and homeowners associations in business disputes and governance matters. He has litigated numerous commercial contract cases, FDCPA disputes, TCPA claims, unfair business practice cases, trade libel and false advertising claims, and restrictive covenant disputes, as well as claims brought against individual owners, executives, and directors and officers for alleged breach of fiduciary duty and alleged improper usurping of business opportunities.
Mr. Hammack has litigated high exposure cases for amusement park and studio clients, utilizing his knowledge and experience to achieve timely and cost-effective results. He has also represented event cancellation and contingency insurers nationally and internationally, including legal matters arising from such tours as Michael Jackson’s “This Is It” concerts in London, England, Foo Fighters’ World Tour, and Kanye West’s “Saint Pablo” concerts.

- Certain Underwriters at Lloyd’s v. AEG Live, Michael Jackson Company LLC – rescission litigation in Los Angeles against AEG Live and Michael Jackson Company LLC following death of Michael Jackson for Certain Underwriters at Lloyd’s London under a contingency cancellation policy for the This Is It concerts in London, England. Action based upon material misrepresentations and non-disclosures regarding Jackson’s prior drug use. After over one year of litigation, AEG drops its $17.5 million insurance claim for a waiver of costs. Litigation continued and resolved with the Estate of Michael Jackson for the LLC the morning of Underwriters’ motion for summary judgment on rescission and other policy defences.
