Tim Boughey is an Associate in FMG’s Atlanta Office. Tim represents public and private sector employers in all aspects of federal and state employment litigation, ranging from single-plaintiff cases to class and collective actions. His practice consists of representation in employment discrimination, labor relations, contracts, and administrative law matters before all federal and state courts, the Equal Employment Opportunity Commission (EEOC), Department of Labor (DOL), and the National Labor Relations Board (NLRB). He represents employers and provides advice on claims filed under such statutes under the Americans with Disabilities Act (ADA), Title VII, the Age Discrimination in Employment Act (ADEA), the Family and Medical Leave Act (FMLA), the Fair Labor Standards Act (FLSA), WARN, Georgia RICO, the Georgia Whistleblower Act, and constitutional claims brought under 42 U.S.C. § 1983.

In addition to his litigation practice, he also works with clients on preventive strategies for compliance with federal and state employment laws, including, without limitation, Title VII, the ADA, ADEA, FMLA, FLSA, and others. He often provides preventative training to management and employees on workplace best practices and drafts employee handbooks, personnel policies, and other employer documents. Tim leverages his litigation experience and provides practical advice to clients navigating employee complaints as well as when he performs workplace audits and investigations.

As a specialist in public sector employment law, Tim focuses on the representation of cities, counties, school districts, and other government entities. He has served as counsel to ethics boards, pension boards, and as a hearing officer in due process and name-clearing proceedings. Tim enjoys assisting public sector clients with complex issues under the First Amendment and has litigated several high-profile cases under the First Amendment. In addition, he has litigated several collective and class action public sector benefits cases.

Before joining FMG, Tim served as an in-house employment counsel and litigator for the City of Atlanta and worked in the Labor and Employment and Public Sector Employment groups at Elarbee, Thompson, Sapp, & Wilson, LLP – a management-side labor and employment firm. While in law school, he clerked for an EEOC administrative law judge, The Honorable Timothy Hagan. He also served as a student intern in the EEOC’s Atlanta District Office evaluating claims of unlawful discrimination, harassment, and retaliation and assisting the EEOC’s litigation attorneys in enforcement proceedings.
