Barry M. Miller is a partner and Office Chair in the Lexington, KY office at Freeman Mathis & Gary. He focuses his practice on insurance coverage opinions and litigation, including coverage issues related to municipal liability, bad faith and extra-contractual damages, and data management and cyber security law.

He has considerable experience handling technology issues involving data breach defense and electronic discovery as well. Mr. Miller regularly provides instruction and counsel to a variety of groups, including attorneys and business owners, regarding preservation of digital evidence and insurance aspects of cyber liability. In 2017, he earned his accreditation as a Certified Information Privacy Professional/United States (CIPP/US), credentialed through the International Association of Privacy Professionals (IAPP).

He has extensive experience in insurance coverage and bad faith. He successfully argued the case of Troxell v. Kentucky Farm Bureau before the Kentucky Supreme Court to reverse a jury verdict that had been rendered in favor of an insured in a bad faith case. Mr. Miller has also successfully handled many bad faith cases through dismissal, summary judgment, or settlement without any payment for extra-contractual claims by his client insurance company. Barry is adept at synthesizing complex insurance issues and claims and at presenting his client’s position in a thoughtful, well-reasoned and concise manner.
