Kevin M. Ortiz is an Associate in the Sacramento office of Freeman Mathis & Gary, LLP. Kevin has extensive experience defending business organizations of all sizes and individuals in civil litigation throughout the State of California in both state and federal courts.

In the defense against personal injury actions, Kevin has assisted many types of clients, including individual and organizational commercial and residential property owners, commercial tenants, restaurants, contractors, health and fitness clubs, marina and campground operators, outdoor markets, homeowner associations (HOAs), franchise businesses, governmental entities, and companies involved in property maintenance, trucking and transport, courier services, towing, construction materials and equipment supply, agricultural harvesting, farm labor supply, commercial sweeping, manufacture of outdoor power equipment, catering and events, convenience stores and gas stations, snow removal, laser vision correction, assisted-living facilities, night clubs, and waste management.

Kevin has assisted these clients in defending against claims of wrongful death and catastrophic injury, negligence, negligence per se, dangerous condition of property, product liability, medical malpractice, elder abuse, and breach of warranty of habitability, including incidents involving motor vehicle accidents, pedestrian accidents, slip and fall, trip and fall, commercial and residential construction, roadway construction, dog bites, and mold exposure.

Kevin has extensive experience defending contractors in construction defect cases. These cases have arisen out of projects involving small and large commercial properties, residential developments of single-family homes, large apartment complexes, and luxury home properties. Kevin has represented contractors and specialty contractors in a vast majority of the trade classifications recognized by the California Contractors State License Board. Kevin’s defense of contractors has also extended to large property losses involving fire and water losses.

Kevin has experience with assisting in the defense against contract disputes, including one involving the construction of a large consumer-facing website for a global company. Kevin has also assisted clients in professional liability claims stemming from insurance agent and broker services, and actuarial services. The actuarial services case involved actuarial services provided to a large self-insured group, alleging a deficit of millions of dollars.

Kevin dedicates himself to understanding the most up-to-date law and helping his clients navigate the litigation process while obtaining positive results by way of zealous advocacy, including successful dispositive motions, voluntary dismissals, and settlement.  Among Kevin’s achievements are numerous successful motions for summary judgment arising out of premises liability and motor vehicle negligence.

When not in the office or in the courts, Mr. Ortiz enjoys spending time with his family, running, hiking, biking, swimming, weightlifting, reading, and homebrewing.
