Overview

Audrey Wanich is a Senior Counsel in Freeman Mathis & Gary, LLP’s Orlando office and a member of the Firm’s Commercial Litigation/Directors & Officers, and Construction & Design Law Practice Sections. She concentrates her practice on homeowner association (HOA) and condominium association (COA) representation, general commercial litigation, architects & engineers design liability, professional liability matters and construction defects.

With more than a decade of experience in real estate and planned development, Ms. Wanich focuses on representing HOAs and COAs, frequently serving as general counsel to community associations. She provides day-to-day legal guidance on governing document interpretation, contract review and negotiation, covenant enforcement, collections, and reasonable accommodation requests and disputes. She also advises associations on compliance with Florida’s structural integrity reserve study and milestone inspection requirements and provides strategic counsel in implementing resulting remediation and large-scale capital improvement projects.

Ms. Wanich has successfully negotiated the replacement and relocation of utility services for the benefit of associations and has counseled boards on financing and executing significant capital expenditures and repairs.

Her litigation practice includes representing associations in administrative proceedings and civil actions, with significant experience in alternative dispute resolution. She has defended associations against claims involving statutory violations, discrimination, breach of fiduciary duty, and failure to maintain and preserve community property. She also represents associations in post-turnover construction defect claims, as well as in breach of contract and negligence actions brought by owners.

Ms. Wanich is admitted to practice in Florida and South Carolina.  She has presented at DBPR-approved programs, as well as at regional conferences and national programs.  She is an active member of The Florida Bar’s Condominium & Planned Development Committee, where she is collaborating on the upcoming HOA Green Book.
