Overview

Jason M. Pannu, the President of the Tennessee Bar Association in 2018-2019, is a Partner and the Office Chair in Freeman Mathis & Gary’s Nashville office and Co-Chair of the Firm’s Construction and Design Law national practice section. He is also Co-Chair of the firm's Architects & Engineers Design Liability national practice team. Jason has handled a variety of matters in the area of complex commercial litigation, with an emphasis on the construction industry.

As part of his construction law practice, Jason advises architects, engineers, owners, contractors, subcontractors, construction managers, and material suppliers on large-scale construction projects. He regularly appears in State and Federal Courts and arbitration on construction defect, professional negligence, breach of contract, lien, and bond claims.

Jason also has experience handling employment discrimination disputes, professional liability claims, and insurance coverage matters. His employment practice encompasses representing employers in defending against claims under federal and state employment laws, including Title VII, the Americans with Disabilities Act, the Family and Medical Leave Act, and the Tennessee Human Rights Act. In the professional liability area, Jason represents accountants, lawyers, insurance agents, consultants, brokers, and miscellaneous professionals in defending against various claims, including negligence, malfeasance, breach of fiduciary duty, and breach of contract.

Jason grew up in Vancouver, British Columbia, Canada and is fluent in Cantonese Chinese and French.

Representative Cases & Clients
  • Obtained a favorable result for an earthwork contractor in a 7-party arbitration in which the project owner was seeking $28 million related to damage to a warehouse building due to soil subsidence.
  • Achieved a settlement for well under policy limits for a heavy civil contractor on the largest highway construction project in the history of the State of Tennessee related to a catastrophic motorcycle accident that occurred in the construction zone.
  • Obtained summary judgment for a civil contractor on subsurface collapse following the construction of a large strip mall in Nashville.
  • Successfully settled a lawsuit against a blasting contractor brought by a rural community in Middle Tennessee in which the local government alleged blasting activity polluted its water supply.
  • Defended numerous claims against contractors and subcontractors related to alleged accessibility violations at apartment complexes under the Fair Housing Act and Americans with Disabilities Act.
  • Defended numerous lawsuits against a Nashville commercial roofing contractor related to defective roofing installation activities across numerous projects.
  • Obtained a favorable settlement for an earthwork contractor on a Church expansion project in which residents in a nearby neighborhood alleged excessive flooding from the newly constructed additions to the Church.
  • Defended numerous lawsuits against a national fire suppression contractor related to numerous incidents of water damage from pipes bursting.
