Amicus brief submitted in support of Petition to Transfer in Indiana Supreme Court for the Defense Trial Counsel of Indiana

FMG’s Donald Patrick Eckler and Quarles & Brady’s Lucy Dollens recently submitted an amicus brief in support of The Standard Fire Insurance Company (a Travelers company) on their petition to transfer to the Indiana Supreme Court in Bradley Baldwin, et al. v. The Standard Fire Insurance Company, et al.

The issue on which Standard Fire is seeking review, and on which the amicus brief was filed, is whether an insurer discharges its duties to its insured by filing an interpleader in response to a time limited policy limit demand in a situation in which an insurer has a basis to believe that there are more claims of greater value than the limit of the policy and while it defends its insured in the underlying tort lawsuits. On the second issue presented by Standard Fire, the Insurance Institute of Indiana, National Association of Mutual Insurance Companies, and American Property and Casualty Insurers Association, filed an amicus brief on whether it is bad faith for the insurer to act as it did in this matter and whether the consent judgment entered into by the insured with one of the claimants can be used as evidence in the trial on the bad faith claim.
