Public Schools and Free Speech 2021 Update

In the summer of 2021, the Supreme Court addressed the topic of a student’s free speech rights for the first time in decades. As “state actors,” public schools must understand the parameters and boundaries of free speech rights, to mitigate litigation risk when applying policies designed to enforce school codes of conduct. This webinar will provide an overview of the case law establishing the rights, and limitations, to free speech enjoyed by students, teachers/staff, and parents in the public school context. The presenters will highlight the principles courts use to analyze whether an exercise of speech rights in a school context is protected by the First Amendment or unprotected and thus subject to restriction or punishment by a school district.
