FMG attorneys Danielle Ocampo and Chris Weber prevailed on a demurrer on behalf of a local medical clinic, after an attorney, in pro per, attempted to assert an opt-out claim from a class action settlement for alleged violations of the California Invasion of Privacy Act. The plaintiff was a patient of the clinic and alleged that the clinic’s use of pixel tracking technology on its website was a violation of California’s state wiretapping law. The court sustained FMG’s client’s demurrer to this claim on the grounds that the allegations included insufficient facts to show a wiretapping cause of action specific to this plaintiff.
