Wayne Melnick and Sangeetha Krishnakumar secured an early dismissal of a security company in a Gwinnett County, Georgia case. Plaintiff, the surviving parent and administrator of her son’s estate, brought suit against the security company (and other defendants) as a result of a fatal shooting. When plaintiff’s counsel initially refused to voluntarily dismiss FMG’s client, FMG attorneys timely answered and included a notice of frivolous litigation in their responsive pleadings. In our response, we were able to show that the client did not provide security on the property at the time of the shooting, owed no duty to the plaintiff or the decedent, and a failure to timely dismiss FMG’s client would likely result in assessment of costs and fees against the plaintiff. FMG attorneys continued their aggressive negotiations with plaintiff’s counsel and were ultimately able to secure an early dismissal for the client without any formal discovery.
