Jennifer Adair and Eric Retter obtained summary judgment in a premises liability case in which a police officer was injured responding to a riot at a Mexican restaurant during a Cinco de Mayo event. The plaintiff alleged that the restaurant failed to provide adequate security for the event, over-served patrons, and allowed the restaurant and adjacent parking lot to become over-crowded. The State Court of Fulton County awarded summary judgment to the restaurant, agreeing that the Fireman’s Rule prevented the officer from recovering for injuries sustained as a result of the very incident that caused him to be called to the property. The court further agreed that the plaintiff failed to show willful or wanton behavior on the part of the restaurant so as to defeat the Fireman’s Rule.
