Carlos A. Fernández and Cathi Carson-Freymann prevailed against property owners’ motion for injunctive relief in Palm Beach County. The property owners sought to reverse several amendments to the property’s governing documents and subsequent special assessments. The property owners claimed FMG’s client conducted a fraudulent vote to amend the governing documents, and then relied on those amendments to implement the subsequent special assessments. After oral arguments, the Court ruled in our client’s favor, holding that the property owners’ voting rights were not infringed or disenfranchised on by the amendments to the governing documents.
