Bob Chadwick and Jack Doyle prevailed on appeal in the Sixth Appellate District of Texas before three state judges. In this matter a Plaintiff sued his former attorney for legal malpractice. The petition was dismissed on a 91(a) Motion to Dismiss. Plaintiff filed a notice of appeal arguing that he never received proper notice of the 91(a) hearing despite being served through the electronic filing manager. Plaintiff raised this issue for the first time on appeal.  On behalf of the clients, FMG attorneys argued that Plaintiff waived his rights to appeal by not preserving the issue at the trial court. The Court of Appeals agreed with the Appellees that the issue had not been preserved. Therefore, the Court did not have to rule on the issue of notice and affirmed the trial court’s dismissal.
