Warren Hutchison and Kirsten Patzer obtained a defense verdict for a prominent life insurance company client after a week-long jury trial in front of the Suffolk Country Business Litigation Session. The client was sued by two policy holders alleging negligence, fraudulent misrepresentation, breach of fiduciary duty, and violation of Massachusetts’ 93A consumer protection statute in the purchase of three annuity products. The jury found our clients not liable on the negligence and fraudulent misrepresentation claims, and the Court held that our clients did not owe the plaintiffs a fiduciary duty and did not engage in unfair or deceptive conduct in violation of 93A.
