Wayne Melnick and Andy Treese secured the plaintiff’s voluntary dismissal with prejudice of a disputed liability auto accident case after their independent investigation showed the plaintiff lied and made material omissions in both written discovery responses and at deposition.  Plaintiff initially admitted to a single prior Motor Vehicle Accident, but denied other prior or subsequent MVAs and denied prior neck pain. Mr. Melnick and Mr. Treese’s independent investigation identified eight undisclosed prior MVAs, an additional undisclosed MVA three weeks after the subject incident, and a long history of neck pain including a prior surgical recommendation.  After FMG filed a motion for sanctions based on plaintiff’s misrepresentations, he offered to dismiss the case with prejudice if plaintiff would not continue to pursue an award of fees.
