Dana Maine and William Linkous obtained a favorable result in the Gwinnett County Superior Court and in the Georgia Court of Appeals for a client who acted as Community Manager for a condominium association.  On behalf of our client, Ms. Maine and Mr. Linkous prevailed on a motion for summary judgment before the Superior Court on all counts filed by the Plaintiff, including libel, slander, and defamation, based upon the doctrine of res judicata.   Judge Tracie Cason agreed with the arguments made by Ms. Maine and Mr. Linkous that a prior suit filed by Plaintiff in the Superior Court barred the re-litigation of the same matter in this case.  Plaintiff appealed the adverse verdict to the Georgia Court of Appeals, which affirmed the dismissal of all counts in its June 3, 2021 ruling.  In particular, it found that there was sufficient identity between the two lawsuits to apply the res judicata doctrine to bar all of the claims.
