FMG Attorneys Amy Cowan and Nicolas Bohorquez obtained the dismissal of a complaint for writ of mandamus on behalf of the City Council of Peachtree City (“City Council”) in Fayette County Superior Court. The plaintiff, a billboard company, sought to construct 3 signs which required approval from the City Council. The City Council denied plaintiff’s application because the signs applied for did not meet the requirements of the Peachtree City zoning code or the Peachtree City sign ordinance. After Attorneys Cowan and Bohorquez’s oral argument on the motion to dismiss, the court upheld the decision of the City Council, finding that plaintiff’s sole legal remedy was certiorari and not mandamus.
