FMG Attorneys Nancy Reimer, Jessica Kelly, and Brendan Collins obtained dismissal of the plaintiffs legal malpractice action as untimely. FMG’s client previously represented the plaintiff in an action brought by a condominium association seeking to recover unpaid condominium fees and expenses and to establish a lien on the plaintiff’s condominium unit. On the day before a scheduled hearing in the underlying case, our client withdrew from the representation. FMG successfully argued that the statute of limitations for the plaintiff’s malpractice claim began to run upon our client’s withdrawal and the plaintiff’s consultation with subsequent counsel because the plaintiff knew or should have known at that time that she was harmed by the withdrawal and the additional fees she incurred. The court rejected the plaintiff’s argument that the statute of limitations did not begin to run until the court denied the motion that was the subject of the hearing and that the plaintiff had lost.
