FMG attorneys Matthew Jones and Jason Dineros successfully defended a case involving disputed liability arising out of a slip-and-fall incident that took place at a small grocery store. Plaintiff alleged there was a liquid on the ground that our client negligently failed to identify or clean, and as a result, Plaintiff slipped and fell. Plaintiff claimed our client had several issues with respect to its inspection policies and procedures, documentation, and record keeping. Plaintiff’s alleged damages included exacerbation of carpal tunnel syndrome in both wrists, numerous spinal injections, and proposed neck and low back surgeries, which totaled approximately $131,000 in past medical specials and a life care plan of over $1.5 million. Plaintiff’s total request from the jury was a range of $4-$8 million. We asked the jury to award $62,000, assuming they found liability on the client. After a three-week trial and two days of deliberations, the jury returned a verdict totaling $40,000–representing $5,000 in past economic damages, $35,000 in past noneconomic damages, and $0 in future economic and noneconomic damages.
