Brian Goldberg and Anna Perry secured a victory after a three-day jury trial in the United States District Court for the Northern District of Georgia. The case involved claims for specific performance and lost rental income concerning two high-end cabin rental properties in the North Georgia mountains, worth approximately $1.8 million, that FMG’s client sought to purchase. The trial focused on determining which party was responsible for the failure to close as originally agreed. Key factual issues included the parties’ conduct during the closing process and their actions following the discovery of an encroachment. Additionally, the preparation of easement documents and whether FMG’s client refused to close without compensation for the encroachments were central questions for the jury to determine. The jury ultimately ruled in favor of FMG’s client on all critical issues, awarding $306,000 in damages. This win ensured the acquisition of the unique properties and provided compensation for significant financial losses.
