Jessica Kelly and Andrew Vandini obtained full dismissal of a complaint in the U.S. District Court for the District of Massachusetts on the ground that the Massachusetts court lacked personal jurisdiction over our clients, a New York lawyer and his firm. The Court also denied the plaintiffs’ motion to amend the complaint. The plaintiffs, who resided in Massachusetts, had alleged that our clients were responsible for advice given by our clients’ former associate, who was no longer working at our clients’ firm, but remained on our clients’ website at the time of the advice. The Court held that the appearance of the associate on the firms website was not a sufficient contact to confer jurisdiction over our clients in Massachusetts.
