FMG Attorneys Brian Skalsky, Lizel Cerezo, Al Alikin, and Will Hadikusumo, successfully obtained a dismissal with prejudice on behalf of their client, the North Carolina Medical Board (“NCMB”), in California federal court. The plaintiff, a pro se physician, filed suit against the NCMB and its chief executive officer, R. David Henderson, alleging that he was defamed when his inactive status and voluntary surrender of his medical license was reflected on the NCMB’s online license verification system. Plaintiff alleges this precluded his ability to practice medicine in California, thereby depriving him of his property rights without due process of law. FMG filed a motion to dismiss plaintiff’s complaint on the basis that the NCMB, as a state agency, was immune from suit under the Eleventh Amendment. FMG also argued that this immunity was not waived and that the NCMB has an overwhelming interest in ensuring the public’s protection through its license verification system. The District Court agreed with FMG’s arguments and found that it did not have subject matter jurisdiction to hear the matter and granted the dismissal of the complaint with prejudice, without the need for oral argument.
