Attorneys Curt Graham, Austin Anderson, and Xon Hostetter obtained a favorable verdict in Kentucky’s Graves Circuit Court in March 2023. The plaintiff was attacked without warning by an old high school classmate at a local bar/grill and suffered shoulder injuries as a result of the attack. The plaintiff sued the attacker and FMG’s client (the restaurant), alleging that the attacker was overserved. The attacker testified that he was in a “blackout state” at the time of the incident. FMG had to navigate a difficult venue where alcohol sales became legal just years prior. After a three-day trial, the jury ultimately determined that the plaintiff, who had purchased multiple drinks for the attacker, was more liable than the restaurant for causing the incident.
