David Molinari is the managing partner of the Firm’s San Diego Office and also works out of the Firm’s Los Angeles and Orange County offices.  He is a member of the Commercial and Complex Litigation, Commercial General Liability and Business Liability, Construction Law, Insurance Coverage, Labor & Employment, Professional Liability and Errors and Omission National Practice Sections.  He is a member of the Mentoring and Orientation Committee for the Firm’s younger California lawyers.  Mr. Molinari has been practicing for 30 years and is licensed in Arizona as well as California.

Mr. Molinari began his career practicing Criminal Defense where he learned his craft for courtroom and trial work, respect for Courtroom decorum and the application of the Evidence Code.  Since 1996 he has exclusively litigated in the Civil forum representing a variety of clients in numerous industries including the insurance industry, Department of Defense, National Title Insurer, National Life Insurer and National Hospitality Clientele.

Mr. Molinari’s practice also includes substantial representation of companies in lawsuits brought against them by employees.  He litigates a variety of employment discrimination cases, as well as class action and collective wage and hour claims.  He also provides advice and counsel to management regarding employment law issues. 

Mr. Molinari’s Commercial General Liability practice includes defending premises liability claims, defamation and libel claims, commercial general liability casualty claims.  Mr. Molinari was recently recognized for his work in the General Liability field as trial counsel in a “Case of Note” Verdict Search, Volume 16, Issue 32, August 7, 2017:  Farnham v. Nguyen, San Diego Superior Court Case 37-2014-19986 for achieving an extremely favorable defense verdict resulting in the Firm’s client obtaining a recovery of expert fees and defense costs from the opponent.

Mr. Molinari’s Commercial and Complex Litigation practice includes handling financial transactions, particularly focusing on Real Estate financing, Business Torts, Contract disputes, corporate litigation, real estate litigation, real estate title claims and copyright and trademark protection.  His commercial practice includes protecting client’s intellectual property in the areas of trademark and copyright.  He has litigated Title 15 Lanham Act cases, Title 17 Copyright actions.  He has litigated interagency claims before the United States Patent and Trademark Office, Trial and Trademark Appeal Board.  His experience stretches from registering, continuing and protecting clients’ trademarks ranging from a national sporting goods manufacturer to an independent publishing house.

Mr. Molinari’s Construction Law practice includes defending general contractors and geotechnical engineers against construction defect claims, contract drafting and negotiations and representing fidelity and surety clients.  He has tried construction cases to verdict representing general contractors on commercial projects; beating his offer of settlement and recovering expert fees and costs.

Mr. Molinari’s Insurance Coverage practice focuses on defending national insurance companies in Bad Faith cases defending against extra-contractual damages.  He has litigated extra-contractual claims defending carriers in actions based on policy rescissions and alleged failure to settle adverse claims.

Mr. Molinari’s Professional Liability and Errors and Omissions practice includes defending corporate directors and officers on breach of fiduciary duty claims, home owners’ associations and HOA lien enforcement cases.  In the real estate context of this practice section he has defended real estate agents, appraisers and escrow holders in cases of insufficient disclosures, lien priorities, mortgage and title fraud.

Mr. Molinari has been published in California Defense Magazine writing on the issues of Judicial Estoppel and Anti-Slapp regulations on strategic lawsuits.
