David Molinari is the managing partner of the Firm’s San Diego Office and practices in the Firm’s Los Angeles and Orange County offices.  He has over thirty years of trial experience having tried dozens of jury and bench trials to verdict. He has significant class and multi-party experience as well as having handled many significant appellate cases in both California and Federal appeal courts. Mr. Molinari was recognized for his trial work in a “Case of Note” Verdict Search, Volume 16, Issue 32, August 7, 2017:  Farnham v. Nguyen, San Diego Superior Court Case 37-2014-19986 for achieving a defense verdict resulting in recovery of expert fees and defense costs.

Mr. Molinari’s commercial litigation practice particularly focuses on prosecuting and defending intellectual property in the areas of trade secrets, trademark, copyright and confidential information.  He has litigated numerous Title 15 Lanham Act cases, Title 17 copyright actions, and interagency claims before the United States Patent and Trademark Office, Trial and Trademark Appeal Board.  He also handles a variety of business litigation and director and officers cases concerning breach of fiduciary duty, business defamation, False Claims Act, Fair Debt Collection Practices Act, Telephone Consumer Protection Act, RICO, Fair Business Practice Act, shareholder disputes and many other business law and partnership disputes.

Mr. Molinari’s practice includes representing domestic and foreign insurers and reinsurers in coverage disputes and suits for extra-contractual damages claims including actions based on the policy rescissions and alleged failure to settle. His professional liability experience also includes HOAs and defending miscellaneous professionals such as real estate agents, appraisers and escrow holders in cases of insufficient disclosures, lien priorities, mortgage and title fraud. He also has defended contractors and engineers in construction disputes regarding design liability, construction defects, contract drafting and negotiations.  

Mr. Molinari also represents companies in lawsuits brought against them by employees for discrimination, harassment and unlawful compensation discrimination, including class action and collective wage and hour claims.  He also provides advice and counsel to management regarding employment law issues. 

As a seasoned trial lawyer, Mr. Molinari also is called upon by the firm’s clients to defend catastrophic assault, injury and transportation cases given his decades of experience in San Diego and Southern California courtrooms. Mr. Molinari has been published in California Defense Magazine writing on the issues of Judicial Estoppel and Anti-Slapp regulations on strategic lawsuits.
