Justin Boron and Lorne Hiller obtained dismissal in a False Claims Act relator action arising from loans forgiven during the COVID-19 pandemic under the Paycheck Protection Program. A relator plaintiff alleged that our clients were not eligible for the loans and submitted inaccurate information to obtain loan forgiveness. In addition to arguing that our clients were, in fact, eligible for loan forgiveness under the PPP regulations, we also challenged the relator’s right to bring a qui tam action. In response to the motion, the case was dismissed.
