The Status of Consent Under the Telephone Consumer Protection Act

Register for webcast | | Telephone Consumer Protection Act claims continue to be some of the most litigated in the country. As litigants patiently wait for a decision on the appeal of the Federal Communications Commission’s 2015 Declaratory Order, courts continue to issue rulings on the bounds of consent, the primary defense to TCPA claims. This webinar explores the current state of the consent defense under the TCPA. We will explore several recent cases from around the country dealing with the developing standards of consent, some of which are encouraging for defense counsel. We will also discuss best practices for obtaining proof of consent, including specific scenarios that the Federal Communications Commission has already determined to be sufficient or insufficient to qualify as prior express consent, such as third-party consent or the use of a telephone number capturer to obtain leads.
The webinar will begin at 2:00 pm and end at 3:00 pm.
